Terms and conditions

1. Agreement

By creating an account or using Shivakriti Logistics CRM ("the CRM") you agree to these terms on behalf of your company. If you do not agree, do not use the CRM. The person who signs up confirms they may accept these terms for the company.

2. The service

  • The CRM is provided by Shivakriti Tech ("we", "us") for managing inquiries, quotations, jobs, shipping documents, finance and payroll.
  • We may improve, change or remove features. We will give notice before removing anything your company relies on.
  • We may update these terms. The date at the top shows the latest version; continuing to use the CRM after a change means you accept it.

3. Accounts and users

  • Give accurate company and contact details when you sign up.
  • Each login belongs to one person. Keep passwords private and tell us if you think one has been misused.
  • Your company's administrator decides who has access and what each user may see and do, and is responsible for their use of the CRM.

4. Free trial, plans and payment

  • The first 30 days are free. No card is asked for.
  • After the trial the CRM is paid monthly or yearly, per company, in advance. Each plan includes a number of users; further users are charged per month. Prices are shown on the pricing page, and GST of 18% is added.
  • Plans do not renew automatically. When a trial or paid period ends without payment, the account locks until it is paid for. Data is not deleted.
  • We may change prices with 30 days' notice. A price change never applies to a period already paid for.
  • Payments are non-refundable; see the refund and cancellation policy.

5. Your data

  • The records your company enters (customers, rates, jobs, documents, staff details) belong to your company. We use them only to run the CRM for you.
  • Each company's records are kept separate from every other company's.
  • You may export your data, or ask us to delete it, at any time. How we handle personal data is set out in the privacy policy.
  • Make sure you are allowed to store the personal details you enter, such as your customers' and employees' contacts.

6. Acceptable use

Do not use the CRM to:

  • send spam, or e-mail people who have not dealt with your company;
  • store or send anything unlawful, fraudulent or that infringes someone else's rights;
  • try to reach another company's data, test or break the security of the service, or overload it;
  • copy, resell or rebuild the CRM.

We may suspend an account that breaks these rules, with notice where we can give it.

7. Availability and support

  • We aim to keep the CRM available at all times, and plan maintenance outside Indian working hours where possible.
  • We cannot promise the service will never be interrupted or free of errors. Keep your own copies of documents you must not lose; you can export your data at any time.
  • Support is by e-mail on every plan, with priority and phone support on the higher plans as described on the pricing page.

8. Ownership

The CRM, its software and its design belong to Shivakriti Tech. Your subscription gives your company the right to use it while the subscription is active; it does not transfer ownership. Your company's name, logo and records stay yours.

9. Liability

  • We are not liable for indirect or consequential losses, such as lost profit, lost business or penalties from third parties.
  • Our total liability for any claim is limited to the amount your company paid us in the 45 days before the claim.
  • Documents the CRM prepares (quotations, CANs, bills of lading, invoices) are drafted from what your users enter. Check them before you issue them.

10. Ending the agreement

  • You can stop at any time by not paying for the next period. Your account stays usable until the paid period ends.
  • We may end the agreement for a serious breach of these terms, after notice.
  • When the agreement ends you can still ask for an export of your data; we delete it on request.

11. Law and disputes

These terms are governed by the laws of India. We will first try to settle any dispute by talking; if that fails, it is settled by binding arbitration. The courts of Vadodara, Gujarat, India have exclusive jurisdiction over any legal matter. If any part of these terms cannot be enforced, the rest still applies.
